Service Providers

PostHog (Analytics)

We use PostHog (posthog.com) for product analytics. PostHog processes usage and behavioural data to help us understand how users interact with our service. Data is processed under a Data Processing Agreement. PostHog may store data within the EU/EEA. Review their privacy policy for full details.

Legal Obligations

We may disclose your personal data to law enforcement, regulatory authorities, or courts if required by applicable law, to comply with a legal process, or to protect the rights, property, or safety of FRCTL brands, our users, or the public.

Business Transfers

In the event of a merger, acquisition, restructuring, or sale of assets, your personal data may be transferred as part of that transaction. You will be notified in advance of any such transfer and of any changes to this Privacy Policy.

With Your Consent

We may share your data with additional third parties where you have given explicit consent for us to do so.

FRCTL-app is based in Finland, EU. Some of our third-party providers (such as PostHog) may process data outside the European Economic Area (EEA). Withdrawing consent

You may withdraw consent for cookie-based analytics and marketing at any time by:

Withdrawal of consent does not affect the lawfulness of any processing that took place before you withdrew consent.

06 Children's Privacy

Our website and services are not directed at children under the age of 16 (or under the age of 13 in the United States). We do not knowingly collect or solicit personal data from children.

01 Acceptance of Terms

By accessing or using frctl-app.com or any service, content, or feature operated under the FRCTL-app brand (collectively, the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Use ("Terms").

If you do not agree to these Terms, please stop using the Service immediately.

Who these Terms apply to

These Terms apply to all visitors, guest users, and — once available — registered account holders. Using any part of the Service, including simply browsing the website, constitutes acceptance of these Terms.

You must be at least 16 years old to use the Service. This age threshold reflects the digital consent age applicable in Finland and across the EU under GDPR Article 8. If you are under 18, you confirm that a parent or legal guardian has reviewed and consented to these Terms on your behalf.

FRCTL-app is a digital product designed to help individuals train and develop their creative and visionary thinking. The Service is provided by the operator of frctl-app.com ("we," "us," or "our"), a business based in Finland.

The Service is intended for personal, commercial use by end consumers ("B2C"). It is not designed for resale, redistribution, or integration into third-party products without our prior written consent.

We reserve the right to expand, modify, or discontinue any feature of the Service at any time, including the transition from guest-only access to registered user accounts, without prior notice, unless required by applicable Finnish or EU consumer law.

We acknowledge that the standalone term "frctl" (without a hyphen and suffix) is independently used in other commercial contexts, including an unrelated video game. Our intellectual property claims extend specifically to our hyphenated brand marks listed above (FRCTL-app, frctl-app, FRCTL-solutions, etc.) and do not constitute a claim over the standalone term "frctl" in general.

Content & Code

All content, software, code, design, text, graphics, user interface elements, exercises, training frameworks, and other materials made available through the Service are owned by or licensed to us and are protected by copyright, database rights, and other applicable intellectual property laws of Finland and the European Union.

You must not:

  • Copy, reproduce, or redistribute any part of the Service without our prior written consent.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices.
  • Use our brand marks in any way that implies affiliation, endorsement, or sponsorship without written permission.
  • Reverse-engineer, decompile, or attempt to extract source code from the Service.

Your Content

If the Service allows you to submit, upload, or generate content (for example, responses to creative exercises), you retain ownership of that content. By submitting it, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, and display it solely to operate and improve the Service. We will not sell your content to third parties.


04 User Conduct

We want the Service to be a safe and constructive environment. When using the Service, you agree to the following rules:

You must not:

  • Use the Service for any unlawful purpose or in violation of any applicable Finnish, EU, or international law or regulation.
  • Attempt to gain unauthorised access to any part of the Service, server, or network connected to the Service.
  • Introduce any viruses, malware, or other malicious or harmful code.
  • Engage in data scraping, automated querying, or use bots to access the Service without our express written permission.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Use the Service to harass, abuse, threaten, or discriminate against other users or any third parties.
  • Post or transmit content that is defamatory, obscene, hateful, or otherwise objectionable under Finnish law.
  • Attempt to circumvent any technical measures we use to protect the Service or its users.

You are responsible for:

  • Ensuring your use of the Service is lawful in your country of residence.
  • All activity that occurs through your access to the Service, whether or not you authorised it.
  • Keeping your device and connection secure when accessing the Service.

We reserve the right to investigate any suspected breach of these conduct rules and to take appropriate action, including blocking access or reporting activity to the relevant authorities.


05 User Accounts & Security

Current status: guest access only

The Service currently operates as a guest-only experience. No account registration is required or available. The provisions below apply from the point at which user accounts are introduced.

When accounts become available

Once account registration is enabled, the following rules will apply:

  • You may only create one account per person. Creating multiple accounts to circumvent restrictions is prohibited.
  • You must provide accurate and truthful information when registering.
  • You are solely responsible for maintaining the confidentiality of your password and login credentials.
  • You must notify us immediately at hello@frctl-app.com if you suspect any unauthorised use of your account.
  • We will not be liable for any loss or damage arising from your failure to keep your credentials secure.
  • You may not transfer, sell, or share your account with any other person.

We reserve the right to refuse account registration or to cancel an existing account at our sole discretion, particularly where we believe the account is being used in breach of these Terms.


06 Privacy, GDPR & Children

Your privacy matters to us. How we collect, use, store, and protect your personal data, including your rights under GDPR, our use of cookies, data retention periods, third-party processors, and international transfer safeguards that is set out in full in our Privacy Policy, available at frctl-app.com/privacy.

The Privacy Policy forms an integral part of these Terms. By using the Service, you confirm that you have read and understood it. In the event of any conflict between these Terms and the Privacy Policy on a data protection matter, the Privacy Policy prevails.

To exercise a data right

Email hello@frctl-app.com with "Data Request" in the subject line. We respond within 30 days as required by GDPR. You may also lodge a complaint with the Finnish supervisory authority: Tietosuojavaltuutetun toimisto at tietosuoja.fi.

Children's privacy & frctl-juniors

The Service is not directed at children under 16 in the EU (or under 13 in the United States). We do not knowingly collect personal data from children below these thresholds without verifiable parental consent.

frctl-juniors — upcoming launch notice

Before the frctl-juniors service launches, additional safeguards, including explicit parental or guardian consent mechanisms, that will be put in place. Both these Terms and our Privacy Policy will be updated accordingly prior to launch.


07 Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by Finnish and EU consumer law, we make no warranties or representations, express or implied, including but not limited to:

  • That the Service will be uninterrupted, error-free, or free of harmful components.
  • That any specific results, improvements in creativity, or outcomes will be achieved through use of the Service.
  • That all content is accurate, complete, or up to date.

Consumer protection note

Nothing in these Terms limits or excludes any statutory rights you have as a consumer under Finnish law or the EU Consumer Rights Directive (2011/83/EU). Where applicable mandatory consumer protection rules conflict with these Terms, those rules prevail.


08 Limitation of Liability

To the maximum extent permitted by applicable law, we and our officers, directors, employees, agents, and partners shall not be liable to you for:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, revenue, data, goodwill, or other intangible losses.
  • Damages resulting from your reliance on information obtained through the Service.
  • Damages resulting from unauthorised access to or alteration of your data, where you failed to take reasonable security precautions.
  • Any interruption or cessation of the Service.

Where our liability cannot be fully excluded under Finnish or EU consumer law, our total cumulative liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of: (a) the total fees, if any, paid by you to us in the twelve (12) months prior to the event giving rise to liability, or (b) €50.

This limitation of liability reflects a reasonable allocation of risk between us and you, and is a fundamental basis on which we are able to offer the Service.


09 Termination

Termination by us

We may suspend or permanently restrict your access to the Service immediately and without prior notice if we reasonably believe that you:

  • Have materially breached these Terms.
  • Are using the Service in a way that is illegal, harmful, or disruptive to other users.
  • Have provided false or misleading information in connection with your use of the Service.
  • Are acting in a way that exposes us or other users to legal or reputational risk.

Where feasible and not legally prohibited, we will attempt to give you advance notice and an opportunity to remedy the breach before taking action.

Termination by you

You may stop using the Service at any time. Once user accounts are available, you will also be able to delete your account by following the process described in the account settings or by contacting us directly. Deletion of your account will result in the erasure of your personal data as set out in our Privacy Policy, subject to any legal retention obligations.

Effect of termination

Termination does not affect any rights or obligations that arose before the date of termination. Sections 3 (Intellectual Property), 7 (Disclaimers), 8 (Limitation of Liability), and 11 (Governing Law) survive termination indefinitely.


10 Changes to These Terms

We reserve the right to update or modify these Terms at any time to reflect changes in the Service, applicable law, or our business practices.

When we make material changes, we will:

  • Update the "Effective Date" at the top of this page.
  • Post a prominent notice on the Service or, where accounts exist, send a notification to your registered email address.
  • Provide at least 14 days' notice before material changes take effect, where required by Finnish consumer law.

Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.


11 Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Finland, without regard to conflict of law principles. The mandatory consumer protection provisions of your country of residence within the EU are not affected.

Any dispute arising out of or relating to these Terms or the Service that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the Helsinki District Court (Helsingin käräjäoikeus), unless applicable law requires another forum.

EU consumers also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr and may contact the Finnish Consumer Disputes Board (Kuluttajariitalautakunta) at kuluttajariitalautakunta.fi for alternative dispute resolution.
